Daniel Yona Jaoko, a Kisumu based hotel manager accused of killing a man over parking space will spend 7 more days in remand as he awaits a probation report on a pre-bail application.

Yona, a manager at Nyamasaria’s Raygreen Hotel allegedly shot and killed Peter Otieno Ogallo over parking space at Polyview estate on August 17 and has been behind bars since then at the Kodiaga Maximum Prison.

Before meeting his death, Otieno Ogallo was a bus driver at the Modern Coast Bus Company in Kisumu.

KISUMUINSYDER.CO.KE has confirmed that Yona Jaoko on Monday, September 24th appeared in court for bail hearing but the judge ruled that he be remanded until an independent report from a probation officer is availed in 7 days.

“Only the probation officer is best placed to write a detailed pre-bail report. Immediately I receive the report I will determine whether the accused will be released on bond,” Justice Ochieng ruled. 

The accused through his lawyer Mogusu Nyamweya had requested to be released on reasonable bond terms “considering his full cooperation with detectives”, a request that was objected by the prosecutor, Peter Muia.

The prosecutor argued that if released, Jaoko was likely to interfere with and intimidate witnesses.

He added that if he was to be granted bail, that was to be only after all witnesses have testified and been put under protection.

According to the prosecutor, the court shouldn’t release the accused on bail for his own safety as he alleged that members of the public had vowed to lynch him if spotted walking freely.

According to court reports, Yona Jaoko is also facing other charges of illegal possession of firearm, forgery, possession of ammunition and is also suspected to be in possession of other illegal firearms different from the one used for the killing.

The matter will be heard again in October 2nd.
